The UK Supreme Court has issued a favourable ruling for Pontegadea, Amancio Ortega's investment vehicle, in a dispute with Forthwell Limited, the tenant of the historic Rogano restaurant in Glasgow. The decision, dated 17 September, rejects the claim for compensation for business losses following the closure of the establishment in 2020 due to flood damage.
The ruling comes just four months after both parties reached an out-of-court settlement the night before the hearing, scheduled for 20 May. Although the agreement has not been made public, the Supreme Court continued with the process as it considered that the dispute raised a point of law of general public importance, thus setting a criterion that could serve as a precedent.
The damage that led to the closure of Rogano occurred in December 2020 and January 2021, leaving the premises without heating and unable to reopen after the pandemic. Forthwell, which has held the lease since 2013, was seeking the execution of repair works and compensation for lost profits.
